    Terms of Service

    Effective date: October 4, 2026  ·  Last updated: October 7, 2026

    1. Who we are

Timly Pro ("Timly," "we," "us") is operated by Jason Romero, a sole proprietor located in California. You can reach us at usetimly@gmail.com.

    2. What Timly is, and what it is not

Timly is an automated calculation aid. It computes special education compliance timelines from dates and a school calendar that you provide.

Timly is not legal advice. It is not a substitute for your own professional judgment, your district's guidance, or the advice of counsel. It does not create any professional or advisory relationship between you and us.

You remain solely responsible for every compliance decision you make. Timly produces a suggested date. You decide whether to rely on it.

    3. Your responsibility to verify

Timly's output depends entirely on inputs you supply, including your district's first and last instructional days, break ranges, and any district policy settings you enable. We do not validate these inputs and have no way to know whether they match your district's published calendar.

Before relying on any date Timly produces, you agree to verify it against:

    • Your district's official academic calendar
    • Your district's or SELPA's timeline guidance
    • The operative statute or regulation

If you export a PDF and place it in a student's file, you agree to review that document for accuracy first. The document is a user-generated aid, not official guidance from any agency, district, or legal authority.

    4. Accuracy and no warranty

We work to keep Timly's calculations correct and test them against published reference materials. We make no guarantee that any date is correct for your student, your district, or your circumstances.

Timly is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, or non-infringement.

Special education timelines vary by state. Timly currently calculates California timelines only. Using it for another state's timelines will produce incorrect results.

Statutes, regulations, and district calendars change. We may update Timly's calculation logic at any time, and a date calculated today may differ from one calculated previously for the same inputs.

    5. Limitation of liability

To the fullest extent permitted by law, our total cumulative liability to you for all claims arising out of or relating to Timly, whether in contract, tort, or otherwise, will not exceed the greater of:

    (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or
    (b) one hundred dollars ($100).

We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost data, compliance findings, corrective action, compensatory education awards, due process costs, attorney's fees, or reputational harm, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations. Where that is the case, the limitations above apply to the fullest extent permitted.

    6. Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, demand, loss, or expense, including reasonable attorney's fees, arising from your use of Timly, your reliance on its output, or your breach of these terms.

    7. Your data

Timly's calculations run entirely in your browser. Calculations are performed on your device. We do not receive, transmit, or store the dates you enter, the calendars you configure, or any student identifier you type into the tool.

Information you enter is saved in your browser's local storage on your own device. Clearing your browser data removes it. We cannot recover it.

If you purchase Timly Pro, our payment processor, Stripe, collects and holds your email address and billing information. See our Privacy Policy for details.

    8. Timly Pro subscription

Timly's core calculators are provided at no charge and will remain so.

Timly Pro is a paid subscription that unlocks additional features, currently the full-year deadline chart, PDF export, and saved calculations. The feature set may change over time.

Timly Pro costs $79 per year and renews automatically until you cancel. See Section 9 and our Refund and Cancellation Policy.

We may change the subscription price. Any price change will apply to your next renewal term, and we will notify you before it takes effect.

    9. Automatic renewal and cancellation

By subscribing, you authorize us to charge your payment method $79 every twelve months until you cancel.

You may cancel at any time. Cancellation takes effect at the end of your current paid term. You keep access to Pro features until that term ends. We do not prorate partial terms.

You can cancel at any time using the Manage subscription link at the bottom of every page. Stripe will email a one-time sign-in link to the address you used at purchase. You can also email usetimly@gmail.com.

If your subscription term is one year or longer, we will send you a renewal reminder between fifteen and forty-five days before each renewal, stating the renewal date, the amount, and how to cancel.

    10. Acceptable use

    You agree not to:

    • Circumvent or attempt to circumvent any access control on paid features
    • Resell, sublicense, or redistribute Timly Pro access
    • Use Timly in a way that violates any law or any district policy applicable to you

We may suspend or terminate access for violation of these terms.

    11. Changes to these terms

We may update these terms. If we make a material change, we will post the updated terms with a new effective date and, for subscribers, notify you by email. Continued use after the effective date constitutes acceptance.

    12. Governing law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Riverside County, California, and you consent to that jurisdiction and venue.

    13. Severability

If any provision of these terms is found unenforceable, the remaining provisions remain in full effect.
